The photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The photographer shall only make reproductions for the client or the photographer's portfolio, samples, self-promotions, editorial use, website, or for display within or on the outside the photographer's studio. The client is obtaining prints for personal use only and shall not sell said prints. If client is obtaining a print for newspaper announcement, editorial use or website the photographer authorizes client to reproduce the print in this manner credited to the photographer.
If the photographer cannot perform this agreement due to fire or other casualties, act of God, or other causes beyond the control of the parties or due to photographer's illness then the photographer shall return the deposit to the client but shall have no further liability with respect to the agreement. This limitation to liability shall also apply in the event that the photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the clients order.
School Pictures
As a small, independent company, we strive to do our best to capture your child’s photos and keep our costs low for all to enjoy. We absolutely love the kids’ personalities and all that they bring to their photo sessions. With being in mind, please note that as a photographer we will work with your child to take their best picture. If their best that day is not a smile and is what they choose to give us, please know we cannot change their expressions for them.
We will doing a retake day and can offer a 25% off discount on a new paid package if you are not happy with their first, paid for pictures. With the rising costs of prints and the hours of editing and care that goes into each individual photo, this is not something that we can do for free like larger companies can. We’ll do our best to work with you to capture a photo you’ll love.
When we make a mistake, or if there is a photographer error we are happy to re-photograph your child at our expense. For example, glasses lens flare from flash, excessive blurriness due to movement, or unwanted editing of scars or scrapes that was not specified in a paid retouch. Please note that we try our best with what we capture and try to edit things as naturally as we can to put your child’s best face forward.
